MINUTES of a Meeting of the Planning Committee held on Monday 23 March 2009, at 7.30 pm in the Council Chamber, Redbourn Village Hall, High Street, Redbourn.

Recommend refusal. Members felt that the resubmission was not an improvement on those submitted previously. They recommended refusal because the proposed development would have an overbearing impact on neighbouring properties because of its size, scale, bulk, massing and position. The proposal would be contrary to Policy 70 (i) and 72 (ix) of the St Albans District Local Plan Review.

8.4 5/2009/0468 52 Luton Lane, Redbourn, AL13 7PY - erection of two side extensions to the existing property. (Consultation period ends 10 April 2009).

Decision deferred. Members thought it best to defer the decision until a site visit could be made.

15. VILLAGE PLAN

At the last planning meeting concern had been expressed about the discussions with the consultancy firm Urban Practitioners. The matter had been referred to Full Council where it had been agreed that a letter should be sent to St Albans District Council as there had been no opportunity to discuss future planning strategies in the village. A draft letter was approved which voiced concern about the meeting and requested an opportunity to meet with the District Council as members wanted their ideas to inform the Local Development Framework. Members requested that a copy of the document produced (still in initial stages) be enclosed with the letter.

16. CORRESPONDENCE

16.1 Members noted the letter from St Albans City and District Council regarding planning decision for 2 St Mary’s Close. Members felt unable to accept the reasons for planning approval which were given. A copy of the letter to a resident regarding the planning decision for 2 St Mary’s Close was also noted.

16.2 Members noted that the Appendix 6iii - Report on “Review of Development of Control Services” including planning and Appendix 6 iv - Report on LDS were being circulated.

16.3 The e-mails and draft letter concerning parking of tanker lorries at Veolia Toxic Waste Plan. The draft letter was approved.

16.4 A press cutting about planning applications was noted with interest.

16.5 Three members had accepted the invitation to attend a course about planning, to be led by John Young (Interim Head of Planning at SADC). This course will be held at Wheathampstead Parish Centre on Wednesday 8th April, 8.00 to 10.00 pm.

16.6 Two Appeals had been received: 16.6.1 North Barn, Little Revel End Lane. The Clerk was asked to write in support of the decision to refuse permission to grant change of use of poultry house (one) to dog training facility (sui generis) and poultry house (two) to light industry (Class B1) (Ref 5/08/1603).

16.6.2 Ver House, 23-35 High Street. The Clerk was asked to write and support the planning application that had been rejected by St Albans District Council. No objections had been received to the planning application, and members felt that the proposed car park would alleviate the chaos and congestion of car parking in the High Street.

16.7 An e-mail about the Green Belt was noted.

7. APPLICATIONS

7.1 5/09/0161 36 Lybury Lane, Redbourn – Conversion of house to provide two, one bedroom and one, two bedroom self contained apartments. (Papers received consultation expiry date 03.03.09)

Recommend refusal. Previous planning permission had been obtained for an extension on a semi-detached house. The current planning application was asking for a change of use to provide multiple accommodation (ie 3 flats). The proposal would be at odds with the surrounding residential area, and out of character with the adjoining semi-detached dwelling. Refusal was recommended on the grounds of

(i) over crowding of site; whilst supportive of flats this conversion will be detrimental to adjoining semi-detached building. (Pol 72 (i) (ii) access – there would be three entrances into the building which currently has only one (iii) need for parking for 3 flats will give urban feel to village environment (iv) town cramming (Poll 72 (iii)) (v) will become a busy area as density of living accommodation/car movement is next to busy village shop (Poll 34/39) (vi) Considerable impact on neighboring property. (Pol 72 (v))

It was noted that District Cllr Maxine Crawley had called in this application.

10. EAST OF ENGLAND PLAN

10.1 The letter of support sent to Derrick Ashley, Executive Member for Planing, External Relations and Waste in relation to the review of the East of England Plan (Regional Spatial Strategy) to 2031 was noted.

11. LUTON AIRPORT

Members noted the response from Karen Goodman, Airfield Environment Office, Luton Airport and asked the Clerk to forward this to Austin Trueman for comment.

12. M1

12.1 Members noted advice from Balfour Beatty that re-planting/maintenance of planting to begin when project completed. However, they remained concerned that one-third of the plants had died and there was no definite date regarding planting. They felt that a written, detailed response related to the contract was required. They recommended that the matter by taken up by the Footpaths and Common Meeting.

13. PLANNING APPLICATION LOG: An update was tabled at the meeting.

14. VILLAGE PLANNING STATEMENT

Cllr Windle gave a report on the meeting with Urban Practitioners, a consultancy firm who was having meetings with all Parish Councils in the district. Cllrs Windle and Crawley and the Clerk attended the meeting. The consultants had requested that only headlines of the preliminary Village Design Statement (prepared by members of the Planning Committee and agreed by the Full Council) be presented to them. The reason for the meeting and the information presented seemed to have changed at the last minute, and the Consultants indicated that their remit was not to work towards the planning element of the District Councils Local Development Framework although elements of the discussion may be included. Members found this very disappointing and unsatisfactory, and members proposed that Cllr Crawley seek clarification of the role of Urban Practitioners and ascertain if there would be an opportunity for input into the LDF as this was now unclear.

The Consultants said they wished to meet as many people as possible from Redbourn; these would include hard to reach groups (ie Youth Council, elderly). Meetings in the afternoon and early evening would be the better option in order to reach these groups, and 21st April was proposed at the Village Hall. The meeting would be conducted as a surgery or workshop.

The Clerk was asked to write 2 letters:

1. Express disappointment regarding the meeting with Urban Practitioners because the purpose was unclear and therefore its outcome.

2. Request meeting with John Young, Interim Head of Planning at St Albans District Council, the purpose of which would be to put forward recommendations identified in Redbourn’s Village Planning Statement, so that these may inform the Local Design Framework. Members felt this was important, because any decisions with regard to the future of planning in Redbourn should be based on expertise and experience of the village and it surrounding area.

15. CORRESPONDENCE

15.1 The letter sent to St Albans City & District Council regarding planning conditions regarding lorry parking at Veolia Toxic Waste Plant was noted. A response was still outstanding.

15.2 The letter sent to St Albans City & District Council regarding planning permission granted for application 5/08/2249 - 2 St Mary’s Close, Redbourn, AL3 7DD, and a further letter from a resident of St Mary’s close were noted.

15.3 Information regarding meeting to be held by ST Ri FE? was noted.

15.4 Members noted receipt of Three Rivers LDF.

16. PLANNING MEETING DATES

Members agreed that calendar of meetings should be amended to show dates for meetings as Tuesday 14th April, Tuesdays 5th and 26th May and to cancel the December 2009 meeting (but to reconsider if Plans North was moved).

348.1 Moneymarket Investment

The interest paid on the Moneymarket investment had decreased further; 0.6% is the rate for January.

348.2 Budget

Report from Chairman of Finance

Context / Background

As previously noted the budget for 2009/10 and the associated precept will increase sharply. The gross increase will be 20.4% which falls to an increase of 19.2% on a per house basis. The majority of this increase is driven by (a) external events outside our control (lower interest rates/rising insurance costs), (b) the Police Community Support Officer (voted for by the Redbourn Public) and (c) increased support to the Recreation Centre/Cricket. To increase transparency it is important that the reasons for this substantial increase are communicated to the public. We can do this through the newsletter and at the Annual Parish Meeting. The main changes/increases are summarised below.

Following an earlier presentation from the Recreation Centre Board a recommendation was made that £3,500 of the current conditional grant (£7,500) is commuted into a cash payment. The residual £4,000 would remain conditional on the same basis as before and it was noted that the Centre may not need to draw on the conditional grant. Last year the Centre was paid a £1,750 grant; the £1,750 in the table above refers to the incremental year on year amount. The Committee has only budgeted for the cash payment.

The Cricket Club applied for £10,000 to fund the building of a cricket strip. Since then the Cricket Club pavilion has been destroyed and funding is required towards the rebuilding costs. The Finance Committee originally recommended a grant of £1,000 in line with grants given to other organizations, however, this has now been increased to £2,000. The Club will be informed that this is a one-off gesture.

As the Commons and Open Spaces budget has not been fully utilized in recent years it has been agreed that this should not be increased. The budget will be monitored and adjusted, if necessary.

The Museum requires approximately £2-3,000 to repair the Southern Wall. As the building is owned by Redbourn Parish Council the Finance Committee decided to fund the repairs from the building dilapidation fund which was set up for this purpose. The Museum Committee will be encouraged to try to obtain match funding to reduce the burden on the dilapidation fund. A member queried whether the works would be covered by a ten year guarantee from the refurbishment of the building.

A paper from the Salary Review Working Party was circulated recommending an increase of 2% for the Clerk and Administrative Assistant.

349 Resolution

RESOLVED to vary the order of business to take item 6.6 on the agenda as the next item of business.

350 Anti-social behaviour

A letter was received from a resident enclosing an article recently published in the Daily Telegraph regarding measures being taken in Preston to endeavour to decrease incidents of swearing and anti-social behaviour. The measures include

• installation of signs • fixed penalty notices given out by police for public order offences • Imposition of £75 fines given out by council officers for litter offences

It was agreed that instances of bad language in Redbourn would best be tackled by the PCSO and the neighbourhood police officer. The Clerk to ask them to raise this issue with Pub Watch. Members felt that landlords could help by informing customers that bad language would not be tolerated. The Clerk to write to Chief Inspector Hann and ask him to elicit the assistance of neighbourhood officers in tackling this problem. The Clerk to write a letter of thanks to the resident who raised this issue.

CORRESPONDENCE

351 St Albans City & District Council

351.1 Grass Verges in St Albans

A copy letter from a member to relevant District Council members and officers was circulated and noted. The member complained about vehicular damage to grass verges and lack of maintenance of street furniture. He reported that St Albans District Council is targeting two areas in an experiment to prevent damage to verges. He has asked that a strategy be drawn up to deal with this matter. He noted that there are grass verges in Tingeys Close and Tassell Hall could be converted to provide hard standing for cars.

351.2 Traveller Sites

A copy letter from a member to the leader, relevant members and officers of the District Council was circulated and noted. The member expressed concern that despite there being three sites in the village and one within a three mile radius at Three Cherry Tree Lane, Holtsmere End has been suggested for an additional site. Members reiterated their concerns that Tullochside should not be used as a bargaining tool to offset the number of legal sites in St Albans. A member pointed out that it had been built without permission in the Green Belt and should be removed at the earliest opportunity.

251.3 Sheltered Housing Newsletter

The Sheltered Housing Review is to plan for the increasing number of elderly residents in St Albans and to improve the quality and choice of accommodation to meet their needs. The number of elderly people aged 85 and over is expected to increase by 69% by 2025. Quality of life housing for older people is a new strategy that will modernise the provision for the 21st Century. Members noted that no changes are planned for Gertrude Peak House.

351.4 Report on meeting with housing officers and residents

A report was circulated on maintenance problems identified on District Council estates in Redbourn and remedial action required. The Clerk to inform the District Council that in addition to the items mentioned consideration should be given to installing a dog litter bins in Tassell Hall.

351.5 Code of Conduct Training

Councillor Stent and the Clerk agreed to attend the training on the Code of Conduct which is to be held at St Albans District Council on 27th January 2009.

352 Hertfordshire County Council

352.1 Speed Restriction on A5183

An Order has been made to prohibit all vehicles from being driven at a speed exceeding 40mph on the length of the A5183 Redbourn Bypass, from its junction with the B487 Redbourn Lane/Harpenden Lane roundabout south westwards to its junction with the High Street/A5183 St Albans Road roundabout whilst highway safety improvement works take place. The Clerk queried why this road was being prioritised over other roads in the village and why safety improvement works are being carried out here when no complaints had been received about this stretch of road. She was informed that there have been a number of serious accidents along this stretch of road. She has asked for information on these accidents including dates and seriousness of the incidents. She has also expressed concern that these matters were not raised at one of the regular liaison meetings that are held with Hertfordshire Highways and the Gypsy Section.

352.2 Village of the Year

A letter has been received from the Chairman of Hertfordshire County Council encouraging villages to enter the Village of the Year competition. Last year some of the presenters were concerned that the judges did not spend much time speaking to them. It was suggested that consideration be given to taking one judge around the village whilst the other remains talking to representatives from the various village organisations.

352.3 Policing Matters

(i) A memorandum regarding neighbourhood policing was circulated informing the Parish Council of the following:

• Introduction of Neighbourhood Co-ordinator roles • Creation of 11 neighbourhoods across the District • Redbourn is included in Harpenden • Each Ward currently has one police officer. Under the new arrangements one of the new PCs in each neighbourhood will assume the additional responsibility of Neighbourhood Co-ordinator which will include Partnership-orientated Problem Solving, Prolific and other Priority Offenders deployment of PCS Os, Specials, Crime Prevention, Police Website Update, Police Volunteers, Neighbourhood Watch and managing ward meetings. • Redbourn will remain the same • The intention is to alleviate the heavy workload of the Neighbourhood Sergeants • Chief Inspector Partnerships, Richard Hann, has taken over from Sue Wheatley • Harpenden Police Station is to close on Tuesdays, Thursdays, Saturdays and Sundays. On Monday, Wednesday and Friday it is open from 8am to 2pm and 3pm to 5pm

(ii) Policing Plan

The draft policing priorities for 2009/12 were circulated. It was agreed that the questionnaires should be completed individually by councillors and that the clerk should reply expressing concern that no consultation took place over the revised opening hours of police stations.

353 NALC

353.1 Training – “Stepping Stones”

A “Stepping Stones” training event to be held at various venues around the country, the nearest to Redbourn being in London on 10th March.

353.2 Direct Information Service

The December issue of Direct Information Service was circulated and noted.

353.3 Report from Chief Executive on the Development of Parish and Town Councils

The following points were raised in the report

• Support for creation of more town and parish councils • Local Councils should strive to meet highest possible standards and aim to become Quality Councils • Often services are best delivered at a local level • NALC has received funding to support a national programme to promote the quality parish council scheme, subsidiarity and devolution of services, creation of new councils, promotion of participatory budgeting, training

Three copies of a consultation paper on Communities in Control are being circulated. Members were asked to give any comments they may wish to make to the Clerk. Comments are required by 12th March 2009.

At a recent neighbourhood watch meeting questions were raised regarding the traffic calming in Lybury Lane. The Clerk to forward a copy of the Hertfordshire Highways minutes to Barry Welch.

i) Redbourn in Bloom – 17th November 2008

A meeting was held with Cllr Donald regarding the District Council grant for improvements to the street scene. It was agreed that the planter, plants and new sign at the entrance to the village would be an acceptable project. Costings must be given to Andrew Robinson, St Albans District Council, within the next two weeks. Suggested schemes for next year include a new bus shelter in Lybury Lane, additional trees in the High Street.

ii) Redbourn Village Hall Management Committee – 9th December 2008

ii) Redbourn Recreation Centre and Playing Fields Trust

The Chairman reported that the newly appointed Manager had resigned. Directors of the Company are visiting the Centre regularly to deal with day to day problems. It may be possible to manage with a part time Manager by appointing a Duty Officer and delegating some responsibilities to the existing staff. Enquiries for new bookings have been received. Interviews are to be held with two late applicants. An Open Meeting is to be held on 29th January for shareholders and users and anyone interested in the Recreation Centre.

356 Parish Centre

The Specification for the Parish Centre was approved by the Common Footpaths and Open Spaces Committee subject to two amendments. According to Standing Orders and Financial Regulations a public notice of intention to place a contract should be placed in a local newspaper. It was agreed that the notice should be placed in the Herts Advertiser. The Clerk was instructed to inform the Architect of the amendments to the specification and instruct him to send out invitations to tender to the companies agreed by the Commons Committee.

357 Tree on The Park

The Chairman reported that she had been contacted by a resident from South Common who informed her that a note had been placed on a Cherry Tree in The Park stating that the tree was to be felled. The Park Management’s Secretary was not aware that the tree was to be felled. The Clerk confirmed an application to fell the tree had not been received. Councillor Swendell agreed to contact the District Council on this matter.

The next Plans North had been moved to 26 January 2009, and would be held every 3 weeks from that date. Meetings usually take place at Harpenden Public Hall, Southdown Road, Harpenden, AL3 1PD and start at 7.00 pm.

It appeared from the agenda that the only item of business was the application for 2 St Mary’s Close. Cllr Windle will attend to speak on behalf of Redbourn Parish Council’s recommendation to refuse the proposal to build two houses on the site. The Clerk was asked to inform the resident who was objecting to the proposal.

10. EAST OF ENGLAND PLAN

The letter concerning the Panel Report on the East of England Regional Spatial Strategy (RSS) Single Issue Review on Planning for Gypsy and Traveller accommodation in the East of England was noted. The Planning Policy Advisory Panel (St Albans City and District Council) would be meeting on Thursday and would be considering this report. Cllr Crawley would be attending, and it was agreed that she would:

• Identify the density and number of existing travellers’ sites in Redbourn;

• Remind members of the temporary nature of Tullochside

• Confirm the number of planning applications received for Tullochside and the nature of business being conducted there

• Enquire about plans for relocation of Tullochside residents when the temporary permission expires

• Request that in the event that the site be allowed to remain it is not expanded;

• Draw attention to the recent shooting incident in the village and the feud which exists

11. LUTON AIRPORT

Cllr Maynard reported a low flying and noisy airplane on Sunday 18 January at 6 pm. Members agreed that there was an increase of low flying planes, and asked that Austin Trueman be notified, and a letter be sent to London Luton.

Members felt that there were less helicopter flights from the Ramada Jarvis Hotel, although they understood that the reason for this could be seasonal.

It was noted that Austin Trueman had agreed to continue attending meetings with the Police Authority and London Luton Airport regarding air traffic over Redbourn.

12. M1

Members asked the Clerk to contact Balfour Beatty to confirm that one-third of the trees planted appeared to have died, and that these should be replaced.

13. PLANNING APPLICATION LOG: Noted.

14. VILLAGE PLAN

Cllr Crawley confirmed she would be presenting a letter to the Planning Policy Advisory Panel on Thursday written by Cllr Windle about Village Design Statements, and stating how important it is to present our ideas and opinions to the District Council so that they can be included in the Local Development Framework.

15. CORRESPONDENCE:

15.1 Members noted the initial consultation taking place for the update of the Conservation Area Character Statement for Redbourn, last reviewed in 2001. After discussion, members queried why the District Council had gone against the document by giving permission for planning applications contrary to its statements, ie building on land adjacent to 12 Monks Close and development of the backlands of buildings in the High Street (see 10.1, 10.4). Members agreed that the document was excellent, but that in future it should be referred and adhered to when making planning decisions. The Clerk was asked to write to John Young, Interim Head of Planning, expressing their views, and also including the following for consideration in the initial consultation for the review of the document, due to be published in Summer 2009:

9.2 the grounds of Cumberland House (which remains and is privately owned) has been recently developed to include a small development of town houses and a doctor’s surgery; a public garden now exists between the High Street and back of Cumberland House;

9.4 there are plans to demolish the Youth Club and build a new Parish Centre;

9.5 the recently refurbished Cricket Club Pavilion has been raised to the ground by fire and is currently being rebuilt;

9.5 there is another small car park on the Common at the junction of North Common and Lybury Lane;

9.6 some paths on the Common have been upgraded;

10.4 planning permission has been approved for the barn at Scout farm;

16. REVIEW OF PROCEDURE WHEN MEMBERS OF PUBLIC ARE IN ATTENDANCE

Members reviewed the policy public speaking at meetings. It was agreed:

• that the time for the public to notify the Parish Clerk of their wish to attend meetings should be changed to “12 noon on the morning of the meeting”;

• there should be an additional rule that “There will be an opportunity for members of the planning committee to ask questions of the speaker in order to clarify or determine further information”.

Cllr Stent had received an e-mail from a resident concerning the proposed building of the new Parish Centre. Cllr Lowen and Stent asked that this e-mail be circulated to Full Council and the Parish Centre Committees, and that a spreadsheet (detailing the cost of the building, fittings and furnishings) and reply from the Parish Centre Committee be sent back to the Planning Committee.

An e-mail from Austin Trueman concerning Aircraft Noise over Redbourn was noted. Members were pleased to note that a resident, who is well informed and experienced about air traffic, is taking an interest in the number of police helicopter flights and aircraft traffic over Redbourn. They felt it was important for Redbourn Parish Council to continue regular liaison with the Police Authority to regularly confirm numbers of helicopter flights over Redbourn with a view to the cost, numbers of flights and disturbance, whilst remembering the importance and role of helicopters in police business.

16. PLANNING APPLICATION LOG

Members agreed that this was a very useful tool in keeping track of planning applications, recommendations and decisions by St Albans District Council, and that the format was user friendly.

16. VILLAGE PLAN

Cllr Windle spoke about Village Design Statements, a national scheme already adopted by around 200 villages around the country with many others expressing an interest. It was agreed that a Village Development Statement created for Redbourn would clarify future planning in the village, and also be helpful in the consultation and creation of the District Council’s own LDF. However, following a recent meeting with John Young (Interim Head of Planning and Building Control) during which he personally had been fairly supportive of VD Ss, it appeared that St Albans District Council had some reluctance towards them on the grounds that they could overburden planning staff. In view of this Cllr Windle felt that there was a good case for lobbying contacts in the district council regarding the importance of VD Ss. HAPTC had given guidance that villages should do their own statements but should, at the same time, work closely with their District Councils. Cllr Windle had prepared information and examples about Village Design Statements for circulation to all Parish Councillors and the Clerk was asked to circulate the information.

15.1 Ms J Wiggett/Travellers Site at Holtsmere End Lane

Members noted the copy of the letter received in relation to the proposed Travellers Site at Holtsmere End Lane. However, whilst empathising with the difficulties and problems (articulated excellently in the letter), the Chairman reminded members that the issues could not be taken further until planning permission was sought, as travellers are a special case and only proper planning reasons can be used to object to the proposal.

15.2 Correspondence from St Albans District Council

  1. 2.1 Scout Farm and S106 Agreement: Following several communications with the
Planning Department at St Albans District Council, it was confirmed that there is no S106 money available because of the size of the development. The developer had confused the money he had been required to give to the Highways Department at County Hall with what he thought was a contribution to the Care Bus garaging and the village. He had been obliged to pay money into the county pot (£500 per parking place, ie £26,000) towards mitigating any traffic problems resulting from the development.

15.2.2 Verside, Harpenden Lane – the letter from the Planning Department was noted.

2. CHAIRMAN OF PLANS NORTH

John Chambers, Chairman of Plans North was welcomed to the meeting. He explained how he would like St Albans City and District Council Planning Department Officers and District Councillors on Planning Committees to work together with Parish Councils. The problems associated with planning and planning decisions were discussed. District Councillor Chambers proposed an informal evening meeting should take place to consider the difficulties identified by members of Redbourn Parish Council Planning Committee, and suggested members make a list of their concerns.

3.3.3 Information had been received from Dacorum Borough Council concerning Dacorum’s Site Allocations Development Plan Document – Supplementary Issues and Options Paper (November 2008). It was agreed that this should be deferred until the next meeting.

Members heard a representation against the application by Mrs Fuller, and read two letters against the planning proposal. After discussion a vote was taken and it was agreed (5 votes for, 1 against) that there were no objections to the application. However, Members did express concerns regarding the protection of the Yew Tree and existing greenery along boundary fences and lines, and the fact that there was no tree survey as stated in the planning application. Members asked that these concerns be highlighted to the Case Officer, Miranda Burroughes, and the Tree Officer, Andrew Branch.

15. VILLAGE PLAN

Councillors Windle and Crawley confirmed that a meeting was planned with John Young with the objective of ascertaining the support that may be expected from him with regard to the Village Plan.

16. CORRESPONDENCE

16.1 Members noted the response from Paula Wilde with regard to demolition of existing barn/garage and erection of car port and garage with games room over at Elm Cottage, St Albans Road, Redbourn AL3 7D raised by Members at last month’s meeting. Two further points of discussion arose:

(a) Cllr Warren raised the fact that the second planning application submitted, which got approval, looks the same as the plans that were refused initially. The case officer was the same person for each application.

(b) It was noted that the boundary of the property which is on the main road, has a wall and a fence which together are 10’ high. The height of the wall was questioned as it was a condition of planning permission for this listed building, and also Members queried if a wall/fence on a main road of this height was allowed.

The Clerk was asked to write to the Paula Wilde, the Enforcement Officer to query both these issues.

16.2 Members noted the e-mail to Cllr Crawley from Mike Lovelady concerning procedure for calling-in planning applications. Some members asked to have sight of the original e-mail sent to Mike Lovelady.

The Chairman recommended that the response from Mike Lovelady be circulated at Full Council as the situation regarding dual-hatted councillors can be confusing. All Parish Councillors needed to be made aware of procedures with regard to dual-hatted members. She urged that all councillors on Plans who have not been on planning training should do so as soon as possible.

Members agreed that in future the Planning Committee should vote for call-in of applications and, if agreed, requests for call-ins should be sent to all three District Councillors, namely Cllrs Crawley, Swendell and Carr. It should be noted that after a meeting any Councillor can ask any District Councillor to call in an application, as can a member of the public. However, District Councillors do not have to call in an application just because they have been asked, and can call in applications without being asked by Planning Members.

16.3 Members noted the letter confirming withdrawal of appeal by Mr and Mrs A Clinch concerning land adjacent to 12 Monks Close, Redbourn. The case is now closed.

16.4 Members were asked to let the Clerk know if they wished to attend the CPRE Meeting on 27 November ?2007 to discuss pamphlet “20:26 Vision: What’s your vision for the future of the Hertfordshire Countryside” – at which Neil Sinden, Director of Policy, CPRE National Office will speak.

16.5 Members noted the invitation from Planning Officer, Dacorum Borough Council, to attend workshop on 4 December 2008. Concern about Buncefield, the Nickey Line and the erosion of the boundary between Redbourn and Hemel Hempstead was expressed. Councillor Windle said she would attend, and it was hoped that either Cllr Maynard or Cllr Crawley would attend also.

17. ANY OTHER BUSINESS

Cllr Crawley reported that a meeting had been arranged to consider the re-development of Buncefield. Although initially excluded all three Redbourn District Councillors had now been invited to attend. Members expressed the wish to be kept informed of the entire picture of the rebuild and development of the site, particularly as Redbourn was on the perimeter of the site where 2 large drums were being built, and applications for other development were received from time to time. Cllr Crawlley confirmed she would be attending.

Councillor Crawley reported that she would be on holiday but did not feel it was necessary for a Redbourn Councillor to attend the meeting. The application for 11 Tassell Hall is to be considered at the meeting. A condition is to be included that the garage is to be restricted to domestic use.

It was noted that if the Committee wishes a particular application to be called in this must be made clear at the meeting. Applications for which the Committee recommends refusal are not automatically called in.

10. EAST OF ENGLAND PLAN: No further information received.

11. LUTON AIRPORT

Following the discussions on helicopter noise at the last full Parish Council meeting the comments raised at the meeting were sent to Luton Airport. Neil Thompson, Access Manager, London Luton Airport, has said he will pass the letter onto NATS and will also speak to them. He confirmed that everyone should use the visual reference points and they need to ensure that the helicopter pilots operating to and from Ramada Jarvis are aware of them and of the procedures in and out of London Luton airport.

Members reported an increase in heavy aircraft flying over Redbourn early in the morning. The Clerk to write to the authorities to ascertain the reason for this.

12. M1

A member expressed disappointment that noise reduction measures included in the extension of the Ml had not made any difference to the levels of noise experienced in the North of the Village.

13. PLANNING APPLICATION LOG - the planning log was not available.

14. VILLAGE PLAN

The Clerk reported that she had attended a meeting of the LSP at Rothamsted. The Chairman had expressed the importance of the LSP and said that comments channeled through this body would feed through to the Local Development Plan. He urged those present to make comments on notepads provided which would be considered by the LSP panel. The Clerk had submitted comments that village design statements should be included in the LDP. Members were also invited to make comments through the LSP web site via the link on the District Council web site.

15. CORRESPONDENCE

15.1 Correspondence concerning the Planning Application for Bunchers, North Common, Redbourn AL3 7D was noted. Members said that it was not apparent on the application that the extension would have a dominating effect on neighbouring properties. Neighbours had produced photos, with the proposed extension annotated thereon, to illustrate their concerns. The Chairman confirmed that she had called in this application.

15.2 Information concerning a Planning Application for Tullochside was noted. The Chairman has called in this application and asked the officers to investigate the existing buildings which do not appear to have planning permission.

16. ANY OTHER BUSINESS

16.1 Scout Farm: this application was considered by full council who had no objections to the proposal provided it met the approval of the Conservation Officer. Members recognised that the site would be developed and thought the proposal to build a barn like structure, using the existing timbers, was appropriate in the Green Belt. 16.2 Chairman of Plans North: The Chairman of Plans North has expressed an interest in attending Planning Committees of District Councils. It was agreed that he should attend the next meeting on 10 November.

16.3 Elm Cottage: A member noted that the barn in the grounds of Elm Cottage appears to have been removed. A planning application to demolish the existing barn/garage and erect a car port and garage with games room over (5/07/3020LB) was refused on the grounds that the proposal involved the loss of an historic outbuilding. A member agreed to check that the building has been removed and, if so, instruct the Clerk to report this to the Enforcement Officer.

7.10 5/2008/2180 Erection of outbuilding at Tullochside Farm, Hemel Hempstead Road, Herts. (Consultation expiry date 16/10/2008 – papers received).

Members Recommended Refusal on the following grounds:

(a) Members are concerned at the validity of this application, and are concerned that the size of the proposed building is far beyond what is needed for the purposes stated in the application. A building of this size is an inappropriate development and will be harmful to the openness and appearance of the Green Belt.

(b) The Design and Access Statement submitted as part of the Planning Application claims that the proposed barn is for a use which is appropriate in a rural area and is an appropriate development in the Green Belt as set out in Para 3.4 of PPG2. Members submit that this is not the case. Para 3.4 of PPG2 states that construction of new buildings inside the Green Belt is inappropriate unless for the state purposes given in the indented text of Para 3.4. One of these appropriate purposes is for “agriculture and forestry”. This appears to be the justification in the application for appropriate development. However, the Planning Application also includes a declaration in the Agricultural Holdings Certificate (Agricultural Land Declaration under Article 7) that “None of the land to which the application relates is, or is part of, an agricultural holding”. Members noted the declaration (Part 25 of the Planning Application) had been signed by the agent acting for the applicant, implying that the barn would be an inappropriate development on ordinary Green Belt land. Members also noted that Para 3.5 of PPG2 gives examples of facilities that could qualify as being appropriate in the Green Belt. One of these is “small stables for outdoor sport and outdoor recreation". It is questionable therefore that stabling for a horse breeding business complies with Green Belt criteria.

(c) Finally, Members felt it was important to draw attention to the fact that this property includes a temporary Gipsy Site, permission for which is due to terminate at the end of 2009. Conditions include that no commerical activity shall take place on the site, and that any buildings and pitches must be removed and the land on which they stood landscaped after that time.

9. ATTENDANCE AT PLANS NORTH MEETING

The next meeting is on Monday 6 October. As Cllr Windle will be unable to attend, Cllr Maynard agreed to go in order to speak against the application for land adjacent to 12 Monks Close.

10. EAST OF ENGLAND PLAN

Members noted the “Position Paper on Sustainable Rural Growth” presented by HAPTC representative Cllr Judith Watson at a recent East of England Rural Forum meeting. They agreed in principle with the points made but wondered about the viability of putting the suggestions into practice in view of the current climate. With regard to Redbourn, members felt that landlords need to keep rents reasonable to enable business in the High Street to be sustained, and that transport facilities should be improved. Comments required by 30 September 2008. The Clerk was asked to send these observations.

13. PLANNING APPLICATION LOG - an updated copy for the year was tabled at the meeting.

14. VILLAGE PLAN

Cllr Crawley informed members that John Young, Interim Head of Planning and Building Control, intended to visit Redbourn on the morning of 16th or 17th October to talk about a Village Design Statement. Members agreed that it was important to have a policy for the future development of the High Street. Cllr Warren agreed to stand in for Cllr Windle if she was unable to attend the meeting.
